The Law

Summary

Federal law clearly gives immigration officers the power to arrest, detain and remove people who are in the U.S. unlawfully, and the Supreme Court has repeatedly confirmed that immigration enforcement is a federal job. The real legal fights are about how that power is used: home entry without a judge’s warrant, stops based on appearance or location, notice before removal, and use of force. This page is a plain-language summary, not legal advice.
